Re:     s-CAL Grievance Updates

The Union sends out updates regarding grievances that have been upheld, denied and/or pending. The updates will also be available on the WEBLOG at www.ibt210mx.tyepad.com. If anyone has any questions concerning the material in the updates feel free to contact the Union office anytime.

As in the past, please note there are may more outstanding and settled grievances of a personal nature that will not be part of these updates unless the decision affects the group as a whole. There are also several more issues/potential grievances in the pipeline that are in the process of being worked through pursuant to Article 19.A.1 and will not be part of these updates unless the issue(s) are reduced to writing.

Grievance Updates
Field Trip Bypass
Two grievances were filed alleging Field Trip bypasses for out of service aircraft in IAD. The first was for an aircraft that was out of service pending the R&R of an engine EEC. The work was performed by s- UAL Technicians working as vendors for the carrier.

The second grievance was a result of a slide pack that needed to be replaced again on an aircraft that was in IAD. That work was also preformed by s-UAL Technicians working as vendors for the carrier.

Both grievances will be presented at the April 10, 2012 System Board.

Field Trip Bypass
A Field Trip (FT) grievance was filed regarding how the company called out the trip. The Company utilized the unplanned as opposed to planned FT list when making the calls pursuant to Article 12 of the Collective Bargaining Agreement.

This grievance will be heard at April 10, 2012 System Board.

Scope Violation – Contracting Out Work
A LaGuardia grievance was filed stating that a portion of the security check which has been a long standing maintenance practice is now being performed by the cleaners, violating Article 1 (Scope) of the CBA.

The union is contesting this practice as work which has been performed solely by Tech Ops. for almost ten (10) years.

This grievance is on the agenda and will be heard at the April 10, 2012 System Board.

Overtime Call-Out
A grievance has been filed contesting on how the company is implementing the overtime callout procedures. Callouts are being made and the employee(s) are not being told where the overtime is allocated.

The union believes this to be a violation of the standing practice that has been established throughout the system and this grievance is also on the agenda and will be heard at the April 10, 2012 System Board.

GSE 502 Utility Lead Specialists
A grievance has been filed regarding GSE Utility Leads. The Company continues to use utility specialists as Leads instead of creating a 502 Lead Specialist position. The Union contends that this is a violation of Article 3.

The grievance has been appealed to the second level.

Filling of Vacancies
Two grievances where filed whereby employees were allegedly deemed not qualified for bid area 118.

The union contends that as per the CBA Article Three (3) if the qualifications are in doubt they may be resolved by administration of an appropriate trade test or via the grievance process.

A determination on which shall be used is still pending. The grievance is currently on Joint Hold.

Narita Field Trip
There was a grievance filed regarding a F/T to recover an aircraft in Narita Japan. The Company contends that it has the right to determine if there is or isn’t a need for manpower during field trips. In this case the company determined that there was an overabundance of manpower on the filed trip and decided to send employees home as needed via seniority order and not the order that they were via the Field trip list.
The union contends that this is a violation of Article 12 Field Trip procedures.

The case was presented @ the February System Board and a ruling is now pending.
