Re: s-Cal Grievance updates
The Union sends out updates regarding grievances that have been awarded, denied and/or pending. The updates will also be available on the WEBLOG at www.ibt210mx.tyepad.com. If anyone has any questions concerning the material in the updates feel free to contact the Union office anytime.
As in the past, please note there are may more outstanding and settled grievances of a personal nature that will not be part of these updates unless the decision affects the group as a whole. There are also several more issues/ potential grievances in the pipeline that are in the process of being worked through pursuant to Article 19.A.1 and will not be part of these updates unless the issue(s) are reduced to writing.
Grievance Updates:
Dulles Field Trip
As stated in the prior updated two grievances were filed regarding bypasses for out of service aircraft in IAD.
The first was an EEC replacement for which the work was conducted by s – UAL Technicians working as vendors.
The second was a slide pack that needed to be replaced due being out of limits. This work was also conducted by s-UAL Technicians working as vendors.
Both grievances were settled out prior to the April 2012 System Board.
The Company has agreed that this was a violation of our agreement and those employee(s) next on the filed trip list will be compensated with the amount of hours they would have gotten had they been awarded the trip.
Amsterdam Field Trip
A grievance was settled prior to System Board regarding how the company called out a Field trip. The Company utilized the unplanned list as opposed to the planned FT list when making the calls thereby, having those employees on the planned list bypassed.
The Company has agreed to compensate those employees whom have been bypassed in accordance with the Collective Bargaining Agreement Article 12.
Narita Field Trip
As previously stated in the last update there was a grievance filed regarding a F/T to recover as aircraft in Narita Japan. The company contends that it has the right to determine if there is or isn’t a need for manpower during F/T. In this case the company determined that there was as overabundance of manpower on the F/T and decided to send employees home as needed via seniority order and not the order that they were callout via the F/T list.
This case was presented @ the February System Boards and a decision is now pending
Field Trip Bypass
A Field Trip grievance was filed regarding a trip to MBJ. There was a scheduled trip for an aircraft with a #1 Engine hydraulic leak. Two technicians were sent to recover the aircraft and during that period another aircraft experienced engine HMU problems and had to remove and replace the #2 HMU. The company failed to call out another trip and used the same two technicians to recover the aircraft.
The union has filed a grievance as per Article 12 of the CBA and this grievance is scheduled to be heard @ the next System Board.
Wrongful Evaluation
A grievance has been filed regarding a GSE Utility Specialist who has been wrongfully evaluated as per Article 5 D of the CBA for the position of GSE technician. The company contends that the employee has been appropriately evaluated and afforded every available opportunity under the Collective Bargaining Agreement that is required and will remain as a GSE utility Specialist.
The case is scheduled to be heard locally @ the System Board of Adjustment.
Previous Scope Violation – Contracting Out Work
A grievance from LGA was filed stating that a portion of the security checks which has been a long standing MX practice is now being performed by the cleaners, violating Article 1 (scope) of the CBA.
The union contends that this is a long standing practice one which as been accomplished by the rank and file for almost ten (10) years.
The case has been deadlocked and will be scheduled to be heard via arbitration as per Article 20 of the Collective Bargaining Agreement.
Previous Overtime Call-Out
The union filed a grievance regarding how overtime was being call out and on how the rank and file were not being told where the overtime assignments are. The union contends that this has been a long standing practice as to informing the rank and file to where there assignment are and for one which has been agreed to and set forth by the company for an extended period of time.
Thereby, the company has agreed prior to Board that all midnight hangar overtime callouts will be called out first and callouts must indicate to the rank and file as to where the overtime assignment is.
GSE 502 Utility Lead Specialists
A grievance has been filed regarding the GSE Utility Leads. The company continues to use Utility Specialists as Leads instead of creating a 502 Lead Specialist position. The union contends that this is a violation of Article 3 and has filed a grievance.
Since the last update the company has agreed to staff a Lead Utility Specialist for 502. This position has been awarded to the most senior utility specialist as per the Collective Bargaining Agreement Article 5 (five).
